Terms of Service for Kreativ

These Terms of Service ("Terms") are the rules for using Kreativ, a creator marketplace operated by ValueChoice Technologies ("Kreativ", "we", "us"). Please read them before you use the app. By using Kreativ you agree to them.

1. Acceptance of These Terms

By creating an account or using Kreativ, you agree to these Terms and to our Privacy Policy at valuechoice.in/kreativ/privacypolicy. If you do not agree, do not use Kreativ.

You must be at least 18 years old, and legally able to enter into a contract in India, to use Kreativ. If you use Kreativ for a business, you confirm that you are allowed to act for that business.

2. What Kreativ Does

Kreativ is a platform that helps hirers (brands, shop owners, businesses and individuals) find local creators and send them inquiries. Creators include photographers, videographers, video editors, influencers, graphic designers, models, makeup artists, reels creators and product shoot creators.

Kreativ only introduces hirers and creators to each other. We are not a party to any agreement between a hirer and a creator. We are not an employer, agent, agency or contractor of any user, and we do not supervise, direct or guarantee anyone's work.

3. Your Account

• You log in with your mobile phone number and a one-time password (OTP).
• Give true and current information, and keep it up to date, including your WhatsApp number.
• You are responsible for everything done through your account. Keep your phone and your access safe, and do not share your OTP.
• One person should not run several accounts to avoid a suspension or a limit.
• You can use Kreativ as a creator or as a hirer. Each role has its own profile.

4. Creator Profiles

If you join as a creator, you create a public profile that hirers can see. Other creators in your own city can also see it. A profile can show your name, photos, city, categories, bio, availability, portfolio, packages, prices and badges.

You are responsible for your profile. You agree that:

• Everything on your profile is true, and not misleading.
• You own the content you upload or have permission to use it, including any people, brands or music in it.
• Your packages and prices are ones you are willing to honour, and you will tell a hirer clearly what is included.
• You keep your availability up to date.

You can list in up to three categories. Boosts, badges and ranking do not promise any number of inquiries or any amount of work.

5. Hirer Inquiries

If you join as a hirer, you can browse creators for free and send an inquiry with a brief (purpose of the work, location, event date, budget range, deliverables and other requirements). Send an inquiry only if you are serious about the work, and describe it honestly.

A creator may accept or decline an inquiry for any reason, or may not reply. Kreativ does not promise that any creator will accept, reply or be available. An inquiry is not a booking or a contract. It is a request to talk.

6. Contact Sharing and WhatsApp

When a hirer sends an inquiry and the creator accepts it, the hirer's WhatsApp number is shared with that creator so the creator can contact the hirer by call or WhatsApp. If the creator declines, the number is not shared. The hirer is told that the creator will contact them, and is not shown the creator's WhatsApp number.

By sending an inquiry, a hirer agrees to this sharing. Keep your WhatsApp number correct in your profile so a creator can reach you.

Use a number you receive only for the work you were asked about. Do not save it to send promotions or spam, share it with others, or use it to harass anyone.

Kreativ does not send automated WhatsApp messages in v1. A person from Kreativ may message you on WhatsApp, for example about a verification request.

7. No Booking or Deal Payment in Kreativ

In v1, Kreativ does not take bookings and does not handle payments between hirers and creators. Hirers and creators agree on the scope, price, schedule, advance, delivery and payment directly with each other, outside Kreativ.

We do not take a commission on those deals. We do not hold money in escrow, and we do not collect, keep or pay out money for any deal.

Because we are not part of the deal, we are not responsible for a hirer not paying, a creator not delivering, late or poor-quality work, cancellations, refunds or any other dispute between them. We recommend that you agree the details in writing (for example on WhatsApp) before work starts.

8. Check Before You Work Together

Kreativ does not verify hirers in v1, and it does not guarantee anyone's identity, intentions or ability to pay. Before a creator contacts or works with a hirer, the creator should check who the hirer is, starting with the hirer's business or online profile. The app shows this reminder to creators on every inquiry.

Hirers should also look at a creator's portfolio and ask questions before they hire. Take sensible precautions: meet in public or safe places, tell someone you trust where you are going, and do not send money or sensitive documents to someone you have not checked.

9. Verification Badges

Badges are signals, not guarantees.

• Social Verified: our team checked, by hand, a public social media page that the creator gave us. It does not confirm the creator's identity, skill or reliability.
• Work Verified (where offered): past clients named by the creator confirmed working with them. Kreativ does not independently check these confirmations.
• Other badges, such as Top Kreativ: granted by us at our discretion.

We may grant, refuse or remove a badge at any time, for example if we find the information was false or the creator breaks these Terms. A badge does not mean that Kreativ recommends a creator or endorses their work.

10. Creator Request Board

The Request Board lets a creator post a job they need another creator for. It works between creators in the same city and category.

• Post only real requests, with honest details. Do not use the Board to advertise, spam or collect numbers.
• When a poster accepts a reply, the poster and that creator each see the other's WhatsApp number. Use it only for that request.
• Any creator can report a request. We may close a request, remove a reply or limit Board use at any time.
• We may set daily limits on posts and replies, and posting may need a paid plan.
• The Board is only an introduction between creators. Sections 7 and 15 apply to the Board as well: any deal between creators is outside Kreativ.

11. User Conduct

You agree not to:

• Give false information, impersonate another person or business, or hide who you are.
• Post content that is unlawful, abusive, hateful, sexually explicit, defamatory, threatening or that infringes someone's rights.
• Upload content you do not own or have no permission to use.
• Harass, pressure, threaten or cheat other users, or ask for money or sensitive information under false pretences.
• Take a conversation or payment off Kreativ for the purpose of fraud.
• Use Kreativ to send spam, scrape or copy profiles, contact details or content, or build a database from them.
• Create fake inquiries, replies, views, badges or confirmations, or try to inflate a ranking.
• Try to break, probe, overload or get around the security, limits or rules of Kreativ, or use it with bots or automated tools.
• Use Kreativ to do anything that breaks the law.

12. Content You Provide

You keep ownership of the photos, videos, text and other content you provide ("Your Content"). You give Kreativ a free, non-exclusive licence in India and around the world to host, store, display, resize and share Your Content in the app, the website and our service messages, for as long as it is on Kreativ, so we can run the service and show your profile to hirers and other users.

You promise that you have the rights to give this licence and that Your Content does not break the law or anyone's rights. We may remove content that breaks these Terms or the law. We do not own your portfolio, and a creator's work for a hirer is governed by whatever the two of them agree.

13. Payments to Kreativ

Hirers use Kreativ for free. Creators can list for free during a free listing period. The length of that period is set by us per city and shown in the app. After it ends, a creator needs an active paid membership to stay visible.

We also plan to offer optional paid items to creators, such as boosts and portfolio upgrades. Prices, duration and what each item includes are shown in the app before you buy.

• Payments are made through Google Play Billing. Google handles the payment, and we do not see your card, UPI or bank details.
• A boost gives priority in the rotation for the category and city you chose. It does not promise a top place, a number of views or any work.
• Memberships and upgrades may renew automatically until you cancel them in Google Play. Cancel before the renewal date to avoid the next charge.
• Refunds follow the rules of Google Play and Indian law. Kreativ may change prices or plans for the future, and will show the new price before you are charged.
• If we stop a plan or remove your account because you broke these Terms, we are not required to refund the unused period, except where the law says so.

Some of these items may not be available yet. We will update the app, and these Terms where needed, before they start.

14. Reviews

Reviews and ratings are not yet available. When they launch, a hirer will be able to review a creator after a completed inquiry, and the review may appear on the creator's public profile. We may remove reviews that are fake, abusive, misleading or against our rules. We will update these Terms before reviews go live.

15. Disputes Between Users

If you have a problem with another user, try to solve it with them first. Kreativ does not decide disputes between users and is not responsible for their outcome. You can report a user or a request to us at admin@valuechoice.in, and we may take action on the account, such as a warning, a limit or a suspension. We are not required to do so, and we may not be able to share the outcome with you.

For anything involving money, theft, threats or other offences, you may contact the police or a lawyer. We may share information with them when the law requires it.

16. Suspending or Ending Accounts

• By you: you can delete your account in the app, under Settings. What happens to your data is described in our Privacy Policy. Deleting your account does not cancel a deal you already agreed with another user, and does not cancel paid plans bought through Google Play, so cancel those there.
• By us: we may warn you, hide your profile, remove content, limit features, suspend or end your account at any time if we think you broke these Terms or the law, put another user at risk, or harmed Kreativ, or if we must do so by law. Where we can, we will tell you why.
• If your account is suspended or ended, you should stop using Kreativ. Sections that by their nature should continue, such as 7, 12, 17, 18 and 19, continue after that.

17. Disclaimers

Kreativ is provided "as is" and "as available". As far as the law allows, we do not promise that:

• Kreativ will always work, be secure, be free of errors, or be available at all times;
• any user, profile, badge, review, request or content on Kreativ is accurate, safe, lawful or suitable;
• you will receive any inquiries, replies, work, income or results;
• a user will do what they say, deliver, or pay.

You use Kreativ and deal with other users at your own risk and judgement.

18. Limitation of Liability

As far as the law allows, Kreativ and ValueChoice Technologies, its owners and team are not liable for any indirect or consequential loss, or any loss of income, profit, business, data or reputation, arising from your use of Kreativ or from dealing with other users, including any unpaid fee, undelivered work, dispute, cancellation or harm caused by another user.

Where the law does not allow us to exclude our liability, our total liability to you for any claim related to Kreativ will not be more than the amount you paid to Kreativ in the three months before the claim, or ₹1,000 if you paid nothing.

Nothing in these Terms limits any right you have under law that cannot be limited by contract.

You agree to be responsible for the harm caused by your own breach of these Terms or your own content, and to compensate Kreativ for losses and claims that come from it, as far as the law allows.

19. Changes, Governing Law and Contact

Changes. We may update these Terms from time to time. When we do, we will change the effective date above and publish the new version at valuechoice.in/kreativ/terms. If a change is important, we may also tell you in the app. If you keep using Kreativ after a change, you accept the new Terms. If you do not agree, stop using Kreativ and delete your account.

Governing law. These Terms are governed by the laws of India. Courts at Surat, Gujarat have jurisdiction over any dispute about them, unless the law gives you the right to go to another court.
